AVAILABLE LEGAL SERVICES
The Legal Plan of Local 138 provides the following legal services to eligible members and their families.
Each of the following has a forty (40) hour limitation of legal services per case.
1. Consultations
2. Consumer Matters
3. Criminal Matters
(a) All criminal matters that are brought in
New York State Courts, including violations,
misdemeanors and felonies from arraignment
through disposition.
(i) This would not include traffic matters
unless the traffic matter is a criminal
offense.
(ii) Criminal matters in Federal Courts are
Excluded.
4. Decedent estates
(a) Non-contested administration or probate of
estate of member of the Plan or spouse.
(i) This would not include services for the
administration or probate for a deceased
non-member.
5. Estates
(a) Representation of the uncontested beneficial
interest of the eligible member in any estate
proceeding in New York State.
6. Excess Coverage
(a) Representation in matters where judgment is
being sought against the member beyond the
insurance monetary amount.
7. Health Care Proxies
(a) Drafting and execution.
8. Landlord/Tenant Proceedings
(a) Defense of Tenant only.
9. Living Wills
(a) Drafting and execution.
10. Matrimonial Matters
(a) Supreme Court or Family Court in New York State.
(b) Covered matters are divorce, separation,
annulment, support or custody proceedings.
(i) Only the member of the group will be
covered.
11. No Fault Proceedings
(a) Representation in enforcing the members
motor vehicle no fault insurance benefits.
12. Powers of Attorney
(a) Drafting and execution.
13. Property Damage Claims.
14. Real Estate Proceedings
(a) Sale, purchase or lease of any property for
primary residence of member and spouse.
(b) Refinance of mortgage for primary residence.
(c) Family residence deed transfer
(i) Business or investment property excluded.
15. Wills
(a) Preparation and execution of a will for member
and spouse.
In the event a member wishes legal services in a non-covered matter, the firm of BENJAMIN J. KLEMANOWICZ, JR. P.C. at their option will provide the necessary legal services for such a matter at one-third (1/3) less than their customary fee.
